Abstract
This article responds to the Supreme Court 2007 decision in Parents Involved in Community Schools v. Seattle School District, also known as the "PICS" case, and looks at it through the lens of the English acquisition needs of Latino ELs. The author argues that if Latino ELs are to receive constitutionally guaranteed access to opportunities to learn English, there must be mechanisms permitted for identifying and implementing best practices and beneficial educational contexts most conducive for ELs' academic success.
